Agreement to Terms

Welcome to Snakk Norsk! These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Etero AS ("we," "us," or "our") regarding your access to and use of the Snakk Norsk mobile application (the "App") and related services (collectively, the "Services").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

Eligibility

Age Requirements

  • You must be at least 13 years old to use the App
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian
  • By using the App, you represent and warrant that you meet these age requirements

Account Requirements

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not share your account with others or allow others to access the App through your account

License and Access

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile device
  • Access and use the Services for your personal, non-commercial use

License Restrictions

You agree NOT to:

  • Modify, adapt, translate, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code
  • Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.)
  • Use the App for any illegal, unauthorized, or commercial purpose
  • Rent, lease, sell, sublicense, distribute, or transfer the App to third parties
  • Use automated systems (bots, scrapers, etc.) to access the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the integrity or performance of the Services
  • Upload or transmit viruses, malware, or other malicious code
  • Violate any applicable laws or regulations

Subscriptions and Payments

Subscription Plans

Snakk Norsk offers subscription-based access to premium features, including:

  • AI-powered text-to-speech with ElevenLabs (subject to fair use limits)
  • Enhanced AI conversation capabilities
  • Advanced dictionary features
  • Additional learning resources
  • Ad-free experience (if applicable)

Specific features available in each subscription tier, including usage limits, are described in the App.

Subscription Terms

  • Billing: Subscriptions are billed through the Apple App Store or Google Play Store
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled
  • Price Changes: We may change subscription prices with at least 30 days' notice
  • Payment Processing: All payments are processed by RevenueCat and the respective app store (Apple/Google)
  • Taxes: Prices may exclude applicable taxes, which will be added at checkout

Free Access and Premium Features

  • The App is free to download and use with basic features
  • Premium features (such as text-to-speech) require an active subscription
  • When you subscribe, you authorize us to charge your payment method through the App Store
  • We reserve the right to modify feature availability and pricing

Cancellation and Refunds

  • Cancellation: You may cancel your subscription at any time through your App Store account settings
  • Effective Date: Cancellation takes effect at the end of your current billing period
  • Continued Access: You retain access to premium features until the end of the paid period
  • Refunds: Refund requests must be submitted to Apple App Store or Google Play Store according to their respective refund policies
  • No Partial Refunds: We do not provide refunds for partial subscription periods

User Content

Content You Create

When using the App, you may create content such as:

  • Chat conversations with AI tutors
  • Saved vocabulary lists
  • Learning goals and notes
  • Profile information

Content Ownership

  • You retain ownership of any content you create
  • By using the App, you grant us a limited license to use, store, and process your content to provide the Services
  • We may use anonymized and aggregated data derived from user content to improve the Services

Content Standards

You agree that your use of the App will not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Contain offensive, abusive, defamatory, or harmful content
  • Include private information of others without consent
  • Promote violence, discrimination, or illegal activities

AI-Generated Content

Nature of AI Features

The App uses artificial intelligence (OpenAI, ElevenLabs) to provide:

  • Conversational language practice with AI tutors
  • Translations and word explanations
  • Text-to-speech pronunciation
  • Example sentences and learning content

AI Limitations and Disclaimers

  • Accuracy: AI-generated content may contain errors, inaccuracies, or inconsistencies
  • Not Professional Advice: AI tutors do not replace professional language instructors or certified educational programs
  • Language Variations: Norwegian language content may reflect specific dialects or usage patterns
  • No Guarantees: We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose
  • User Responsibility: You are responsible for verifying important information from authoritative sources

Intellectual Property Rights

Our Intellectual Property

The App and Services, including all content, features, functionality, software, and design, are owned by Etero AS and are protected by:

  • Copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • Other intellectual property rights

Third-Party Content

The App includes content from third-party sources:

  • Ordbøkene: Norwegian dictionary data from Bokmålsordboka and Nynorskordboka, used under CC-BY 4.0 license
  • OpenAI: AI technology (used under license)
  • ElevenLabs: Voice synthesis technology (used under license)
  • Other Resources: Learning materials with appropriate attribution

All third-party content is used in accordance with applicable licenses and terms.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • We use third-party services (Supabase, OpenAI, ElevenLabs, RevenueCat)
  • We implement security measures to protect your data
  • You have rights to access, correct, and delete your data

Disclaimers and Limitations of Liability

Service "As Is"

The App and Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability
  • Error-free or uninterrupted operation

Educational Use

  • The App is designed for language learning and educational purposes
  • We do not guarantee specific learning outcomes or fluency levels
  • Results vary based on individual effort, aptitude, and usage
  • The App supplements but does not replace comprehensive language education

Limitation of Liability

To the maximum extent permitted by law, Etero AS and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of business opportunity or goodwill
  • Service interruptions or data loss
  • Errors or omissions in content
  • Damages arising from third-party services

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

User Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Etero AS, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the App and Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you create or submit through the App
  • Your violation of applicable laws or regulations in your jurisdiction

Note: This indemnification clause applies only to the extent permitted under applicable consumer protection laws, including EU and Norwegian regulations.

Termination

Termination by You

You may terminate your account at any time by:

  • Using the account deletion feature in the App settings
  • Contacting our support team
  • Uninstalling the App (note: this does not delete your account data)

Termination by Us

We may suspend or terminate your access to the App immediately, without notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • You abuse the Services or engage in excessive automated usage
  • Your account has been inactive for an extended period
  • We are required to do so by law
  • We discontinue the Service

Effect of Termination

Upon termination:

  • Your license to use the App immediately ends
  • We may delete your account and associated data after 30 days
  • You lose access to all content and data in your account
  • Subscription fees are non-refundable except as required by law

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

Informal Resolution

Before filing a formal dispute, please contact us at martin@etero.no to attempt to resolve the issue informally. We will work in good faith to address your concerns.

Changes to Terms

We may modify these Terms at any time. When we make changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Notify you through the App or via email
  • Provide a reasonable period to review changes

Material changes will be effective 30 days after notice. Your continued use of the App after changes take effect constitutes acceptance of the new Terms.

If you do not agree to modified Terms, you must stop using the App and may terminate your account.
